Terms and Conditions of Lady Vyra
- Subject of the Contract
1.1. Lady Vyra offers her clients (“guests”) services in the areas of BDSM, fetish, bizarre dominance, sex coaching, and related fields (“sessions”).
1.2. The services offered are intended exclusively for the guests’ private entertainment and personal experience. Any further use, in particular for commercial purposes, requires a separate agreement.
2. Scope of Application
2.1. These Terms and Conditions apply to all services provided by Lady Vyra, regardless of the location of the session – studio, hotel, private premises, or any other location.
2.2. By booking an appointment or participating in a session, guests acknowledge and accept these Terms and Conditions. A separate signature is not required.
2.3. These Terms and Conditions are accessible on Lady Vyra’s website (https://ladyvyra.com).
3. Appointments and Payment
3.1. Appointments are binding once they have been agreed upon by the guests with Lady Vyra.
3.2. Upon booking an appointment, a deposit of 30% of the agreed total price of the session is required, unless otherwise agreed. The deposit will be credited toward the total price.
3.3. The agreed total price must be paid in full before the agreed session begins.
3.4. Payments may be made by bank transfer, in cash at the studio, or by any other method accepted by Lady Vyra.
4. Cancellations by Guests
4.1. In the event of cancellation, the deposit or any other payments already made are non-refundable, but may, in certain cases, be applied toward a newly scheduled session within a specified time frame.
4.2. For cancellations made within 12 hours or less before the appointment, the full fee is due and the deposit will be credited accordingly.
5. Conduct of a Session
5.1. Guests are obliged to strictly follow the instructions of Lady Vyra during a session.
5.2. Guests must arrive at sessions clean and well-groomed.
5.3. During the session as well as immediately before and after it, guests must strictly follow all instructions given by Lady Vyra regarding cleanliness, hygiene, and health.
5.4. Lady Vyra reserves the right to terminate a session at any time, in particular if guests violate the above rules or if their behavior endangers the mental or physical well-being of Lady Vyra, third parties, or the guests themselves. This also applies if there are indications that conducting the session could endanger the health of any person involved. In such cases, there is no entitlement to a refund of the fee.
6. Liability and Physical Effects
6.1. Lady Vyra is fully liable for damages caused by intent or gross negligence, as well as for injury to life, body, or health of the guests.
6.2. In cases of simple negligence, Lady Vyra is only liable for the breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the typical, foreseeable damage.
6.3. Liability for indirect damages, such as loss of profit, consequential damages, or financial losses, is excluded to the extent permitted by law.
6.4. Guests acknowledge that the services offered by Lady Vyra may involve particular safety risks. The following safety rules apply:
– Guests are obliged to strictly follow Lady Vyra’s instructions, in particular safety and hygiene rules.
– Only agreed and consensual acts are permitted. Both Lady Vyra and the guests have the right to terminate a session at any time.
– The physical and psychological boundaries of all parties involved must be clearly articulated and respected at all times.
6.5. By participating in a session, guests expressly declare their voluntary and informed consent to the planned activities and the associated risks. Within the context of consensual BDSM and fetish activities, physical effects such as marks or minor injuries may occur. These are part of the agreed play and role design and occur by mutual consent. Guests confirm that they understand the nature of the session, the possible physical effects, and their limits, and that they consent voluntarily. This consent may be withdrawn at any time, either explicitly or by using a safeword agreed upon in advance if desired, with effect for the future.
6.6. Consent may be withdrawn at any time before or during a session with effect for the future, whereupon Lady Vyra will immediately terminate the session. In this case, there is no entitlement to a refund of the fee.
6.7. Guests assure that they are physically and psychologically capable of participating in a planned session, in particular without heart, circulatory, or other conditions that could be adversely affected by physical or emotional strain.
6.8. Guests assume full responsibility for their physical and mental condition and for all risks related to participation. Relevant health limitations or pre-existing conditions must be disclosed to Lady Vyra before the session begins.
6.9. Guests indemnify Lady Vyra against all third-party claims arising in connection with the use of the services, insofar as these are not caused by intent or gross negligence on the part of Lady Vyra.
7. Involvement of Additional Persons
7.1. If Lady Vyra consensually involves additional persons in a session (e.g. dominants, slaves, or other partners), all provisions of these Terms and Conditions shall apply accordingly in the relationship between the guests and these additional persons. By participating, guests declare that they also accept these Terms and Conditions with regard to the involvement of additional persons.
7.2. Responsibility for the actions, decisions, or omissions of additional persons lies exclusively with those persons themselves. Any liability of Lady Vyra in this regard is excluded. The involvement of additional persons always takes place at their own responsibility and expense.
8. Discretion and Publication
8.1. Lady Vyra treats all information about guests – name, address, attended sessions, content – as strictly confidential.
8.2. Guests may only publish or disclose details of a session with the express consent of Lady Vyra.
8.3. Lady Vyra may ask guests to write reports about completed sessions. By voluntarily submitting such a report, guests expressly agree that Lady Vyra may use and publish the content, in whole or in part, in anonymized or pseudonymized form for artistic, informational, or promotional purposes. No remuneration will be paid. Personal data that could allow identification will not be published.
9. Miscellaneous
Lady Vyra is an artistic name. The services are generally provided personally by Lady Vyra; deviating arrangements are possible.
10. Applicable Law and Jurisdiction
German law shall apply exclusively, even if the session takes place outside Germany.
11. Severability Clause
Should any provision of these Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a legally permissible provision shall apply that most closely reflects the intent of the parties and the economic purpose of the invalid provision.
